FMCSA Proposed Rule: SDLA’s & the Clearinghouse
FMCSA is proposing State Driver’s Licensing Agencies (SDLAs) should be prohibited from issuing, renewing or upgrading a commercial driver’s license (CDL) or commercial learner’s permit (CPL) to individuals who are currently restricted from driving a commercial motor vehicle (CMV) due to drug and alcohol violations. This is to ensure drivers are going through the proper return to duty requirements.
FMCSA wants to determine how SDLAs could use the information from the Clearinghouse to increase CMV driver compliance. FMCSA is also proposing revisions for reports of actual knowledge of violations, such as a citation for Driving Under the Influence (DUI), which would be maintained in the Clearinghouse. These proposals are to improve safety on the roadways by increasing compliance with drug and alcohol programs.
