FMCSA Extended Emergency Declaration through February 28, 2021

The Federal Motor Carrier Safety Administration (FMCSA) expanded and extended the Modified Emergency Declaration to be effective through February 28, 2021.

This extension has modifications that allow regulatory relief for specific products that are providing direct assistance to the support of COVID-19. This does not pertain to routine routes or mixed loads with emergency relief products. The specific products include:

  • Livestock and livestock feed;
  • Medical supplies and equipment related to the testing, diagnosis, and treatment of COVID-19;
  • Vaccines, constituent products, and medical supplies and equipment including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19;
  • Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap and disinfectants;
  • Food, paper products and other groceries for emergency restocking of distribution centers or stores.

The declaration continues to allow exemptions of Parts 390 through 399 in the Federal Motor Carrier Safety Regulations (FMCSRs). However, the exemption specifically excludes Part 382 (controlled substances and alcohol use and testing requirements), Part 383 (commercial driver’s license requirements), Part 387 (financial responsibility requirements), Parts 100-180 (hazardous material regulations), and applicable vehicle size and weight requirements.
