DOT Publishes Final Rule to Amend Its Oral Fluid Drug Testing Rule
Yesterday FMCSA released a Final Rule in the Federal Register (89 FR 87792) which amends the DOT’s regulated industry drug testing program as it relates to oral fluid testing.
The final rule will be effective as of December 5, 2024, and includes four distinct updates:
- Clarifies that a qualified urine collector is not a qualified oral fluid collector
- Provides temporary qualification requirements for mock oral fluid monitors
- Identifies which individuals may be present during a collection
- Clarifies how collectors document a sufficient volume of oral fluid was collected
